Public Meeting Sparta City Council, Sparta, MO September 11, 2012
Mayor Joya Cave called the meeting to order at 6:35 pm.
The Mayor called the role: Alderman Virginia Thompson, Alderman Gary Brady, Alderman Steve Otten and Alderman Adam Struble were all present.
Also attending were Mayor Joya Cave, City Attorney Tim Davis and Mickey Viles, City Clerk.
The council members reviewed the Minutes from the August 14th meeting. Corrections required in the August 14th meeting were: page 1, paragraph 4, date should be 2012 not 3012 and page 4,
With those two corrections ordered, Alderman Otten made a motion to accept the Minutes from the August 14, 2012, meeting as presented. The motion was seconded by Alderman Thompson and unanimously approved.
The Aldermen reviewed the financial statements for August, 2012.
Alderman Otten made a motion to approve the financial statements for August, 2012, as they were presented. Alderman Brady seconded the motion. It unanimously passed.
Unfinished Business
Tim Davis, City Attorney, presented a draft of the proposed ordinance for indexing pay raises to employee’s anniversary date of hire. Alderman Otten pointed out that the ordinance did not permit the police chief to conduct performance evaluations and pay raises for the department’s police officers.
After a brief discussion Alderman Otten made a motion to table further consideration until changes could be made to this draft. Alderman Struble seconded the motion. All members voted their approval of this motion.
New Business
Mayor Cave introduced the City’s tax levy for the 2012 - 2013 tax year. Since there was to be no changes from the prior year there was no discussion from those attending.
Consequently, Alderman Brady made a motion to accept the tax levy for the 2012 - 2013 tax years as presented. Aldermen Otten seconded the motion. It was unanimously passed. A roll call vote was
The next item was to authorize Mayor Cave as the official signature to sign the DNR documents for the water tower project. Alderman Otten made a motion to designate Mayor Cave to sign the necessary DNR documents for this project. Alderman Struble seconded the motion and it was approved unanimously. The council next considered recommendations to allow some of our staff members to attend several training sessions. The specific sessions were:

The next item to come before the council was to establish procedures to obtain a new Municipal Judge to replace Judge Jared Clinton who will soon be moving to St. Louis. Mayor Cave said she had already instructed that ads seeking a new Municipal Judge be placed on the Missouri Bar Association website. She anticipated this search could take several months to select a new Judge. Meanwhile, she will be designating a Judge - or various Judges - to preside over the Sparta Municipal Court.
The Council then discussed that the city’s major insurance policies will be expiring in March and April, 2013. It was decided that the city will soon begin advertising for potential insurance brokers and/or agencies to bid on the city’s policies.
City Attorney Tim Davis next presented a proposed new city ordinance designed to prohibit non law enforcement officers, people and/or vehicles from impersonating law enforcement officers and/or The proposed ordinance was read once in its entirety and a second time by title.
After a discussion of this proposal Alderman Otten made a motion to adopt this ordinance as it was written. That motion was seconded by Alderman Struble. It was adopted by a 3 to 1 vote.
A copy of the preceding ordinance is hereby made apart of these Minutes.
The next item was a proposal to modify the aldermen and mayor’s annual compensation from the city to be less than $ 600.00. As presently stated in the ordinances all aldermen and the mayor are to be paid an annual compensation of $ 600.00.
It was acknowledged that any such changes made at this time could not be implemented until the next council is seated in April, 2013. Furthermore, in March and April, 2012, the mayor and those aldermen who served a full year term as of that time will be paid their annual $ 600.00.
In addition, around April, 2013, those members who served for a full year during the April, 2012 through March , 2013, will receive an annual $ 600.00 compensation for their service to the city.
The Internal Revenue Service require that any parties - except corporations - that receive payments totaling over $ 600.00 or more from any source are to be issued a form 1099 and these payments shall be included in the payee’s federal and state income tax returns.
Therefore, if the council members receive less than $ 600.00 from the city annually they would not be required to include compensation on their state and federal income tax returns.
Alderman Brady made a motion that as long as the current compensation remains in effect the aldermen and mayor’s annual compensation be reduced to $ 599.00. Alderman Otten seconded the motion and it was adopted unanimously. The roll call vote was:
Randy Teague addressed the council seeking redress and clarification as the Utility Ordinance stated procedures as to when and how much a landlord should be responsible for the utilities when a tenant moves out with unpaid utility bill(s).

Mike Yonker gave the monthly report for the park board. He said they would like to purchase
Alderman Otten made a motion, seconded by Alderman Struble to authorize the board to spend up to $ 1,000.00 for these boards. The motion passed unanimously. The roll call vote was:

The park board will be advertising to construct a Dish [Freebee] Golf Course.
Alderman Thompson made a motion to authorize the park board to advertise for this construction project. The motion was seconded by Alderman Brady and unanimously approved. The roll call vote was:
Police Chief Rick Crawshaw presented the department’s monthly report which included 91 calls for service; 21 citations issued and 6 arrest were made during the month.
Alderman Otten inquired if the city knows the current depth of our water wells and what level are our pump pipes in those wells.
There being no further business to come before this meeting, Alderman Otten made a motion to adjourn. Alderman Thompson seconded the motion and it unanimously passed.
