Public Meeting Sparta City Council, Sparta, MO August 14, 2012
Mayor Joya Cave called the meeting to order at 6:30 pm.
The Mayor called the role: Alderman Virginia Thompson, Alderman Steve Otten and Alderman Adam Struble were all present.
Also attending were Mayor Joya Cave, City Attorney Tim Davis and Mickey Viles, City Clerk.
The Aldermen reviewed the financial statements for July, 3012.
Alderman Otten made a motion to approve the financial statements for July, 2012, as presented. Alderman Struble seconded the motion. It unanimously passed.
City Attorney Tim Davis presented a prepared resolution to formally accept former Alderman Jim Campbell’s resignation from the City Council which Mr. Campbell read publically at the end of the July 10th meeting.
That Resolution was approved by Aldermen Thompson, Otten and Struble. A copy of that Resolution is made a part of these Minutes.
Mayor Cave declared that Alderman’s seat from Ward I officially vacant.
Mayor Cave then nominated Gary Brady to fill the unexpired portion of the term as the second Alderman from Ward I.
Alderman Otten made a motion to ratify Gary Brady as the second alderman from Ward I. Aldermen Struble seconded the motion. Aldermen Thompson, Otten and Struble approved the motion.
Gary Brady was sworn in by City Clerk Mickey Viles.
Alderman Brady took his seat on the City Council.
City Attorney Davis then introduced a proposed Ordinance adding City Code Sections 117.210.1, 117.210.2 and 117.210.3 pertaining to the City’s vacation and sick leave policies.
Mr. Davis pointed out that the City has a vested interest in the welfare of city employees.
The discussion focused on - once accrued - the amount of vacation time that could be carried forward from year to year. It was the considered opinion of the aldermen that a maximum of eighty (80) hours would be permitted to carry forward.
All graduated steps in the permitted vacation would be calculated on the anniversary date of the employee’s time of being hired by the city.
After inserting clause limited the maximum of eighty (80) hours that may be rolled over from year to year Alderman Otten made a motion to adopt the proposed Ordinance. Alderman Brady seconded the motion. A roll call vote was:

Mr. Davis then introduced a prepared Ordinance prescribing the necessary procedures to impeach an elected official.
After a discussion of the provisions of this ordinance Alderman Thompson made a motion to table this topic. There was no second for this motion.
Mr. Davis read the title again.
Alderman Otten made a motion to adopt this ordinance. Alderman Struble seconds the motion. A roll call vote was:

The next item was whether Alderman Thompson is qualified to serve as an alderman from Ward I. City Attorney Davis read a letter he wrote on July 25, 2012, discussing evidence that had been presented that Alderman Virginia Thompson had not paid her sales / use taxes for the quarter of April, May and June, 2011, until a lien - number 201123800009071 - was placed on some of her property on January 17, 2012, and removed on February 24, 2012.
Stephen Meier introduced himself as an attorney representing Alderman Thompson and objected to the Council discussing Mrs. Thompson’s tax matter in an open meeting. He further suggested the newly adopted Ordinance governing impeachment procedures for elected official would need to be followed if this subject were to be pursued further.
The matter was dropped for this meeting.
New Business
The Aldermen authorized Mayor Cave to sign the Intergovernmental Agreement (IGA) to permit the city to receive funding from Christian County Commission for street and road projects.
Alderman Brady makes a motion to authorize the Mayor to sign this agreement. This motion was seconded by Alderman Thompson and unanimously approved.
Mandy Jones of the Sparta Community Development spoke about their “Race For Jobs” which will be held during Persimmon Days. This race is one of their fund raisers. Their mission is to assist new businesses, i.e., welcoming them to town, ribbon cuttings, publicity, etc.
They agreed to provide Minutes of their meeting to the city.
The Council then considered hiring Kamera Anderson as the Police Administrative Clerk and to assist with Municipal Court Clerk duties. She will be helping implement and developing the capabilities of the CrimeStar software and other administrative duties.
Alderman Brady made a motion to hire Mrs. Anderson to serve in this position. That motion was seconded by Alderman Otten and unanimously passed.
The next matter to come before the Council a request to authorize a policy of indexing pay raises to an employee’s anniversary date of hire. After a discussion it was decided to table this matter and have the City Attorney prepare an ordinance establishing a procedures of granting such pay increases. This / these procedure(s) could be adopted along with an employee evaluation and/or review sheet into an employee manual at a future time.
Police Chief Crawshaw gave the monthly report for the Police Department. The highlights were 86 calls for service; 21 citations and 5 arrests. Officer Winslow will complete his training and begin soloing on August 17th.
All officers qualified with their firearms. The four (4) active reserve officers all have completed their hours for the month. New bullet proof vests have been ordered.
Mayor Cave read the reports from the Sewer Department for the months of June and July, 2012. No major problems were encountered. It was recommended that the city purchase a chop saw capable to cut 6” and 8” steel pipes in the event of another break in our water lines.
The reports from the Water Department and Municipal Court are included with these Minutes.
The Park Department was inadvertently omitted from the agenda for this meeting. Their next movie night is August 18th.
There being no further business to come before this meeting, Alderman Otten again made a motion to adjourn. Alderman Struble seconded the motion and it unanimously passed.
